1. OVERVIEW

Welcome to GRPD GEAR. These Terms of Service (“Terms”) apply to your use of our website, online store, and related services (together, the “Services”).

The terms “we”, “us” and “our” refer to GRPD GEAR LIMITED, a company registered in New Zealand. Our store is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products to you.

By accessing or using our Services, including browsing or purchasing from our store, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.

2. ELIGIBILITY & ACCOUNTS

You must be at least the age of majority in your place of residence to use our Services.

You may shop with us as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account.

We reserve the right to suspend or terminate accounts, refuse service, or cancel orders where permitted by law, including in cases of suspected misuse, fraud, or breach of these Terms.

3. PRODUCTS & USE

We sell gym and weightlifting accessories designed to provide support and assistance during training.

Our products are not medical devices and are not a substitute for professional advice, instruction, or supervision. Improper use, misuse, or lifting beyond personal capability may result in injury. You are responsible for ensuring products are used appropriately and safely.

Product descriptions and images are provided for general guidance only. Actual colours or appearance may vary depending on your device.

All products are subject to availability and may be modified or discontinued at any time without notice.

4. ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including due to stock availability, pricing errors, or suspected fraudulent activity.

Orders are only confirmed once payment has been successfully processed and you receive an order confirmation email.

You may request cancellation within a limited time after placing your order. Once an order has been processed or dispatched, cancellation may no longer be possible.

5. PRICING, CURRENCY & TAX

Prices are displayed in the applicable currency based on your location.

  • New Zealand customers: Prices include GST.
  • Australian customers: Prices currently exclude Australian GST. Duties and taxes are not applicable at this time but may change in the future in accordance with Australian tax requirements.

Prices do not include shipping unless expressly stated.

We reserve the right to change prices, promotions, or offers at any time.

6. PAYMENTS

We accept payments via Shopify Payments, Afterpay, PayPal, Shop Pay, and other methods made available at checkout.

All payment processing is handled securely by third-party payment providers. We do not store or have access to your full payment card details.

7. SHIPPING & DELIVERY

We ship using a range of third-party carriers, including NZ Post, DHL, and Aramex.

Delivery timeframes are estimates only and are not guaranteed. Delays caused by carriers, customs, weather events, or other factors outside our control are not our responsibility.

If a parcel is lost or damaged in transit, we will investigate the issue on a case-by-case basis and work with the carrier where appropriate.

Nothing in this section limits your rights under applicable consumer protection laws.

8. RETURNS & REFUNDS

Returns, exchanges, and refunds are governed by our Refund Policy, which forms part of these Terms.

Change-of-mind returns may be accepted subject to conditions outlined in our Refund Policy.

Faulty or incorrect items are handled on a case-by-case basis in accordance with New Zealand and Australian consumer law.

9. PROMOTIONS & GIVEAWAYS

From time to time, we may run promotions, discount codes, or giveaways. These may be subject to additional terms and conditions, which will apply in addition to these Terms.

10. REVIEWS, FEEDBACK & USER CONTENT

Customers may submit reviews, feedback, or tag us on social media.

We will only reuse customer photos, videos, or other user-generated content for marketing purposes with permission.

By submitting reviews or feedback, you confirm that your content is accurate, lawful, and does not infringe third-party rights. We reserve the right to moderate or remove content at our discretion.

Where liability cannot be excluded under consumer law, our liability is limited to the remedies required by law.

You agree to indemnify and hold harmless GRPD GEAR from any claims, losses, or damages arising from your breach of these Terms or misuse of the Services.

16. TERMINATION

We may suspend or terminate access to our Services at any time where permitted by law. Obligations incurred prior to termination survive termination.

These Terms are governed by the laws of New Zealand.

If you are an Australian consumer, nothing in these Terms limits your rights under the Australian Consumer Law.
